The Fictitious Business Name (FBN) must be published within 45 calendar days in an adjudicated newspaper in Tulare County. The publication is subject to fees determined by and payable to the newspaper of your choice. The newspaper selected for the publication of the statement should be one that circulates in the area where the business is to be conducted.

The first publication must appear in the paper before day 45. Newspapers require lead time before publication, and it is your responsibility to meet the newspaper deadline so that publication occurs in time. If you miss the publishing deadline, you must re-file your FBN statement with the County Clerk and pay all fees again. The statement must be published once a week for four consecutive weeks with at least five days between each date of publication. The filing is complete when the Clerk's Office receives the proof of publication. Please verify the procedure for returning the publication with your selected newspaper, as this process may vary. All information on the FBN statement will be published.

An affidavit of publication shall be filed within 45 days after the completion of the publication. If a refiling is required because the prior statement has expired, the refiling need not be published unless there has been a change in the information required in the expired statement, provided the refiling is filed within 40 days of the date the statement expired (B&P Code 17917Government Code 6064).
