For a business owned by an individual, a fictitious business name is any name that does not include the owner's last name (surname) or that implies additional owners (e.g., "Company," "and Company," "and Sons," "Associates," etc.).
Example:
John Smith Painting is not a fictitious business name.
Smith and Company Painting is a fictitious business name.
For corporations, limited liability companies (LLCs), or limited partnerships, a fictitious business name is any name other than the exact name registered with the California Secretary of State. A fictitious business name should not include a business entity suffix, such as LLC, Inc., or Corp. unless the business is actually organized as an LLC, corporation, or similar entity.
