After a Fictitious Business Name Statement has been filed with the County Clerk, publishing it in a local newspaper is required under the following circumstances:
- A new Fictitious Business Name Statement filing
- A renewal or re-filing of a Fictitious Business Name Statement that includes changes
- A renewal or re-filing of a Fictitious Business Name Statement occurring more than 40 days after the expiration date
- The filing of a Statement of Abandonment of use of a fictitious business name
- The filing of a Statement of Withdrawal from Partnership operating under a fictitious business name
When publishing is required, statements must be published in a newspaper adjudicated to have general circulation (Government Code § 6000). The Fictitious Business Name Statement must be published once a week for four consecutive weeks, with the first publication appearing within 45 days of the filing date. Contact the newspaper promptly so it has enough time to prepare the statement for publication. If the statement is not published on time, a new statement must be filed, and additional filing fees will apply.
An affidavit of publication must be filed with the County Clerk in the county where the Fictitious Business Name Statement was originally submitted. This affidavit must be filed within 45 days after the completion of publication, in accordance with California Business and Professions Code Section 17917(d). Typically, the newspaper will submit the affidavit directly to the Clerk’s Office.
